Today I have received an email from this "Fubo Data Privacy Settlement" as a scam legal notice.

The email threatens me with the fake legal notice to make me nervous and visit their fraud scam website and give my personal data so that they can do the fraud. The full copy of the email is given below.

Be aware, guys, this is all fake. Do not visit the website, and do not give any of your personal information.

What is this Emailed Notice about? A proposed Settlement has been reached in a putative class action lawsuit against fuboTV, Inc. and fuboTV Media, Inc. (collectively, “Defendants”), and each of their respective former, current, and future affiliates. The lawsuit claims that Defendants collected, stored, used, distributed, or retained Personally Identifiable Information in the form of information which identifies a Person as having viewed specific videos or services from a video tape service provider and/or other personal information or data in violation of the Video Privacy Protection Act, 18 U.S.C. § 2710 et seq. (“VPPA”). The Settlement seeks to settle these and related claims as further described in the Settlement Agreement.

Defendants deny these allegations, specifically deny that they have engaged in any wrongdoing whatsoever, and deny that Plaintiffs and members of the proposed class are entitled to any relief whatsoever. Nonetheless, if approved by the Court, the Settlement resolves the claims identified in the Settlement Agreement and provides a process by which Settlement Class Members who do not exclude themselves can potentially receive a Cash Payment.


Who is included? You may be a Settlement Class Member if, on or before May 29, 2025, and while residing in the United States or its territories, you (i) had an account to use the Fubo Platform or (ii) used the Fubo account of another Person to watch Video Content on the Fubo Platform. Your household members may also be Settlement Class Members if they meet those requirements. Please share this notice with your household members so they can understand their options under the Settlement.

What are my options if I am a Class Member? If you are a Class Member you have options:

Submit a Claim Form to Receive a Cash Payment. To receive money from the Settlement, you must submit a Claim Form by September 12, 2025. You may obtain a copy of the Claim Form at www.VPPADataPrivacyFuboSettlement.com, and you may submit your Claim Form online at the same website, or by U.S. Mail to the Settlement Administrator at Fubo Data Privacy Settlement, c/o Kroll Settlement Administration LLC, P.O. Box 225391, New York, NY 10150-5391. If the Settlement is approved and your claim is deemed timely and valid, a check will be mailed to you or electronic payment will be sent to the account you choose. The amount of the Cash Payment is currently unknown, but all Settlement Class Members who submit Approved Claims will receive an identical share of the $3.4 million Settlement Fund after payment of Settlement Fees and Expenses, Attorneys’ Fees and Expenses, and Service Awards. Additionally, Settlement Class Members who make the California-specific certifications set forth in Section IV(2)(b) of the Settlement Agreement shall be entitled to a Cash Payment of 1.1 times the Cash Payment amount distributed to Settlement Class Members who did not. Exclude Yourself. You may exclude yourself from the Settlement. If you do so, you will not receive any Cash Payment, but you will not release any claims you may have against the Released Parties (as that term is defined in the Settlement Agreement) and are free to pursue whatever legal rights you may have by pursuing your own lawsuit against the Released Parties at your own risk and expense. To be excluded from the Settlement, Requests for Exclusion must be postmarked or delivered by email by August 28, 2025. You will receive no Cash Payment or other relief if you exclude yourself. This is the only option that allows you to ever be part of any other lawsuit against the Released Parties about the legal claims in this case. If you do not exclude yourself and the Court approves the Settlement, you will be bound by the Court’s orders and judgments and will release your claims against the Released Parties. Object to the Settlement. If you wish to object to the Settlement, you must file and serve an objection explaining to the Court why you do not like the Settlement by August 28, 2025. If you object, you must also serve your objection(s), including all papers or evidence in support thereof, by mail or hand delivery, upon Settlement Class Counsel and Defense Counsel, at the addresses listed at VPPADataPrivacyFuboSettlement.com. The Final Approval Hearing is currently scheduled for October 6 , 2025, at 9:00 a.m. CDT/CST. Do Nothing. If you do nothing, you will receive no money from the Settlement Fund, but you will still be bound by all orders and judgments of the Court. Unless you exclude yourself from the Settlement, you will not be able to file or continue a lawsuit against Defendants or other Released Parties regarding any of the Released Claims. What happens next? The Court, located in Courtroom 2008 of the Eighteenth Judicial Circuit Court of DuPage County, 505 N. County Farm Road, Wheaton, Illinois 60187, will hold a Final Approval Hearing at 9:00 a.m. CDT/CST on October 6, 2025 (or such other date as set by the Court) to decide whether to grant final approval to the Settlement. If there are timely and proper objections, the Court will consider them. If set by the Court, a remote Zoom Meeting ID will be made available on https://‌18thjudicial.‌org/‌18thJudicial/‌Remote-Court-Hearings and www.‌VPPADataPrivacy‌Fubo‌Settlement.‌‌com prior to the hearing. The Court will listen to people who have timely and properly asked to speak at the Final Approval Hearing. Settlement Class Counsel will apply to the Court for an award of attorneys’ fees of up to $1,360,000, as well as Service Awards for the Class Representatives of $2,500 each. The Court will decide how much to pay Settlement Class Counsel and what Service Awards, if any, to award Plaintiffs. After the Final Approval Hearing, the Court will decide whether to approve the Settlement. We do not know how long these decisions will take. You may attend the Final Approval Hearing, but it is not required. You or your attorney may ask permission to speak at the Final Approval Hearing at your own cost. The date and time of the Final Approval Hearing may change without further notice. Who represents me? The Court has appointed lawyers to represent the Settlement Class in this matter. You will not be charged for these lawyers; the lawyers will request to be paid from the Settlement Fund. If you want to be represented by your own lawyer, you may hire one at your own expense. The Court has also chosen Ne’Tosha Burdette, Catherine Beasley, Andrew Baker, and Matthew Berman to represent the Settlement Class.
